After 13 days of deliberation, the jury returned a verdict in the drug conspiracy trial against defendants Howard K. Stern, Dr. Kristine Eroshevich and Dr. Sandeep Kapoor. The jury alerted Judge Perry that they reached a decision and read the verdicts yesterday afternoon. The jury first announced the acquittal of Dr. Sandeep Kapoor on all charges. Shortly after, the jury announced that Howard K. Stern had been found guilty on two felony counts of conspiracy – giving false names and acting by fraud to obtain prescriptions. Smith’s psychiatrist Dr. Khristine Eroshevich was convicted of the same two conspiracy charges and was also found guilty on two additional charges of “prescribing and furnishing sedatives and opiates to an addict.”
Sentencing for Stern and Eroshevich is scheduled for January 6, 2011. A spokeswoman from the District Attorney’s office indicated that “both defendants are looking at possible maximum of at least three years in state prison.”

Glad to hear that Dr. E will have to be responsible for her actions but what about Dr. Kapoor – why did he get off without even a slap on the wrist, so to speak?
It’s pretty obvious to me that Stern and these doctors knowingly participated in a conspiracy to procure drugs for a known addict. I applaud the jury and hope that these doctors, celebrities and their sycophants think twice before they obtain and abuse prescription drugs from now on!
Glad to hear Dr. E. and Howard Stern may get some punishment of some kind. Any what about Kapoor??? I wonder why the jury thought he was not guilty??
Ms. Brenman, could you please share with us your personal thoughts on this case and outcome from your lawyer and personal point of view? I know if I were a lawyer,I would be so disgusted by Howard K Stern and these 2 Doctors.Here’s a couple of facts that have not been addressed much. It seems from testimony in the case that Dr. Kapoor most likely (cough) prescribed the very Methadone that killed Daniel Wayne Smith. Dr.Kristine Eroshevich it seems (again cough)prescribed the very Chloral Hydrate that killed Anna Nicole Smith. How can anything about that be right and just?? Eroshevich in fact never kept one patient chart or medical notes of any kind. There were no tests of any kind ran on Anna Nicole to know if she had even one of the illnesses they have claimed over the last 4 years.No blood tests,no x-rays,no catscans,no MRI’s.How can ANY of this not be illegal and punishable by lengthy prison sentences?What’s happened here is 2 young people are wrongfully dead and a little girl is motherless and no one with any authority is either willing and/or able to get to the bottom of this tragedy.It’s very sad to me.What are your thoughts on this Ms. Brenman and thanks for sharing them with us.
