Will Justice Souter’s Replacement Rock the High Court Boat: Not Likely

After less than two decades on the U.S. Supreme Court, 69 year-old, Justice David H. Souter is retiring. Historically, 69 is a young age for a High Court Justice to retire. Justice Souter, though appointed by President George H. W. Bush, suprisingly veered sharply to the left, voting with liberals of the Court. Clearly he was a closet liberal. There are, however, four conservatives sitting comfortably on the bench. Thus regardless of BO’s pick the Court’s balance will not shift much at all.

President BO read a quick statement moments ago about how he will choose a replacement. BO demands the replacement be “sharp and independent” minded with a “record of excellence and integrity.” He further stated said replacement must possess empathy as “an essential ingredient.” His pick will be “dedicated to the rule of law” and “honor constitutional traditions.” BO will seek somebody who “shares [his] constitutional values” and he hopes to swear in the new justice by the first monday in October when the High Court’s new term begins.

A list of replacements was devised long ago. To name a few: 1) Bronx native with Puerto Rican roots, Judge Sonia Sotomayor; 2) Elena Kagan, Solicitor General; 3) Leah Ward Sears, Georgia Supreme Court Chief Justice; 4) Kathleen Sullivan, Professor and former Dean of Stanford Law School; and, 5) Diane Wood, a federal judge in Chicago who taught at the University of Chicago with BO. Stay tuned as I explore what those “constitutional values” might be, and identify the replacement prospects.

  1. I guess BO is just a puppet, I wonder who is really picking the Justices for him? I would like more transparency on how and by whom these names are suggested to BO.
I also wonder why Bush-One picked Souter in the first place… what was he thinking or who was he pleasing? It looks like BO (or the team behind him) will also get to replace 89-year-old Justice Stevens and 86-year-old Justice Ginsberg.
…I submit that JUDGE JUDY should be appointed and confirmed. She would do the job very well. Seriously.

  2. One thing is for sure, we will have a woman in the mix! I think this will be a good thing. It seems like BO is looking more at character than education. It should be interesting…

  3. Doesn’t President Barack Obama deserve enough respect to be referred to as something other than BO?

  4. It doesn’t bother me that Obama or any other public leader is referred to by his initials. It is unfortunate though that his initials are slang for body odor.

  5. Respect – often nicknames are a sign of affection, not disrespect. Lots of people give their children nicknames out of affection, not disrespect. Perhaps we should interpret this positively ? As affection??? After all, BO is not a god, is he ?

  6. the last time i remember…respect was earned and not expected as a matter of course….I am still in the “wait and see” mode to make my decision as to whether
President Bo deserves my respect…and if so …to what level

  7. The President or “BO” as his sobriquet goes could surprise the female element of the left wing by picking Harvard law professor Laurence Tribe because of his anatomy.

  8. elections have consequences. The last eight years didn’t work out so well – for the economy or privacy rights (see the “patriot act) under Bush rule – try something new…

Ron Paul opposed a lot of what was done the last 8 years and got a lot of support… The GOP would do better to be a lot more like Paul on issues of liberty and get out of peoples bedrooms, churches, and hospital rooms…

Shrub wasn’t called shrub until he drove the country into a ditch… PResident obama probably deserves a year or two just to be fair…

  9. i would love to see comments about the tax system….would a flat tax be more fair…as some assume….? I think i would like for any candidate to politic
    for the people…not the irs…..

  10. Today Pres. BO has announced some good decisions – cutting programs, no more bail-outs ? I hope he asks congress for a flat tax and gets rid of the horror of the compications of the irs. A flat tax would be the best. BO should get some advice from Ron Paul, appoint Ron Paul to some high position.
